Môr Terms and Conditions

These Terms and Conditions apply when you:

  • join the Môr Circle waiting list;

  • complete a Circle entry;

  • become a Circle member;

  • purchase a Môr product; or

  • use the Môr member portal.

Please read these Terms before completing a Circle entry or placing an order.

By completing a Circle entry, accepting Circle membership or placing an order, you confirm that you have read and agree to these Terms.

Nothing in these Terms limits your statutory rights as a consumer.

1. About Môr

2. Eligibility

To complete a Circle entry, become a Circle member or place an order, you must:

  • be at least 18 years old;

  • be legally capable of entering into a contract;

  • provide accurate and reasonably complete information; and

  • use a payment method that you are authorised to use.

We may refuse or cancel an entry, membership or order where reasonably necessary, including where:

  • information is materially inaccurate;

  • fraud or misuse is suspected;

  • a person attempts to create duplicate or misleading entries;

  • payment repeatedly fails;

  • a person abuses our staff or systems;

  • supply would breach a legal or regulatory requirement; or

  • we are unable to deliver to the address provided.

Any action taken under this section will not affect statutory rights or any refund properly due.

3. Products and limited releases

Môr produces small-batch fragrances in limited quantities.

Product descriptions, bottle sizes and prices will be displayed before payment is taken.

Because of the nature of small-batch production and the use of natural materials:

  • minor variations may occur between batches;

  • the appearance of the fragrance may vary slightly;

  • colours may appear different on different screens; and

  • packaging or presentation materials may occasionally change.

Any variation will not materially alter the fragrance or product ordered.

Nothing in this section affects our obligation to provide goods that are:

  • of satisfactory quality;

  • fit for their intended purpose; and

  • as described.

Some fragrances may not be reproduced after the relevant batch has sold out.

4. The Môr Circle

4.1 The waiting list

The Môr Circle waiting list gives people an opportunity to apply for an available Circle place.

Joining the waiting list does not:

  • guarantee that you will be selected;

  • create Circle membership;

  • guarantee access to a particular fragrance;

  • guarantee when a place will become available; or

  • create an obligation to purchase.

No product payment is taken merely because you enter your mobile number on the initial waiting-list page.

4.2 Receiving the Circle entry link

When you enter your mobile number and select JOIN, you request an SMS containing a link that allows you to continue your Circle entry.

If you begin but do not complete the entry, Môr may send up to three reminder messages, as explained in the Môr Privacy and Cookies Notice.

You can stop further reminder and marketing SMS messages by replying STOP.

4.3 Completing a Circle entry

To complete your Circle entry, you may be required to provide:

  • your name;

  • email address;

  • mobile number;

  • delivery address; and

  • a valid payment method.

Completing an entry does not guarantee that you will be selected.

By submitting your payment information, you authorise our payment provider to store the payment method securely and authorise Môr to attempt to take payment if you are selected.

The price of the first fragrance will be displayed before you complete your entry.

4.4 Selection process

Available Circle places may be allocated through a selection process.

The selection process may be random or may use another reasonable allocation method.

The method may vary depending on:

  • the number of available places;

  • available stock;

  • production capacity;

  • delivery availability;

  • eligibility requirements; and

  • the number of people waiting to join.

Completing an entry does not guarantee selection.

4.5 If you are not selected

If you are not selected:

  • you will not be charged for a fragrance;

  • you will not become a Circle member; and

  • you may remain eligible for a future selection process.

You can ask to leave the waiting list at any time by contacting us.

4.6 If you are selected

If you are selected, we will attempt to take the payment authorised during the entry process.

Your first Circle order and membership will be confirmed when:

  • payment has been successfully taken; and

  • we send confirmation of your order and membership.

If payment fails, we may:

  • notify you;

  • provide a reasonable opportunity to update your payment method; and

  • attempt payment again.

If payment remains unsuccessful, we may release the Circle place.

4.7 Continuing Circle membership

The Môr Circle is an ongoing seasonal membership.

Môr ordinarily creates and supplies a new seasonal fragrance approximately every three months. This will be on, or around;

1st January
1st April
1st July
1st October

Dates may change based on holidays

Once you become a member, your saved payment method may be charged for each future seasonal release unless you cancel your membership before the relevant payment is taken.

Before taking payment, we will provide reasonable notice of:

  • the forthcoming release;

  • its price;

  • the expected payment date; and

  • how to cancel your membership.

There is no minimum membership period.

4.8 Prices and price changes

The price of your first fragrance will be displayed before you complete your Circle entry.

Prices for future releases may change because of factors including:

  • ingredient costs;

  • production costs;

  • packaging costs;

  • taxation;

  • delivery costs;

  • regulatory requirements; and

  • other reasonable operating costs.

We will notify Circle members of a price increase at least 30 days before the increased price is charged.

If you do not wish to continue at the new price, you may cancel through the member portal before payment is taken.

A price change will not be applied retrospectively to an order that has already been confirmed.

4.9 Cancelling your Circle membership

You can cancel Circle membership at any time by:

  • signing into the Môr member portal and using the cancellation option; or

  • emailing jason@morperfumery.co.

There is no membership cancellation fee.

Cancellation prevents payment from being taken for future seasonal releases, provided cancellation is completed before the next payment has been processed.

Cancelling membership does not automatically cancel an order for which payment has already been taken.

An existing paid order remains subject to the cancellation and return rights in section 10.

4.10 Returning a fragrance does not cancel membership

Returning one seasonal fragrance does not automatically cancel your Circle membership.

You will remain a Circle member and may be charged for future releases unless you separately cancel through:

  • the member portal; or

  • jason@morperfumery.co.

4.11 Ending membership by Môr

We may end or suspend Circle membership where reasonably necessary, including where:

  • payment repeatedly fails;

  • fraudulent or abusive conduct is suspected;

  • inaccurate information prevents us from administering the membership;

  • the member abuses staff or systems;

  • continuing the membership would breach the law; or

  • Môr permanently discontinues the Circle.

  • the member continually returns the scent.

Where possible, we will provide reasonable notice.

Ending membership will stop future membership charges but will not affect:

  • an existing confirmed order;

  • rights and obligations that arose before termination; or

  • any refund properly due.

4.12 Product availability

Circle fragrances are produced in limited quantities.

Although production is planned according to expected membership numbers, supply, safety or production problems may occasionally prevent us from fulfilling a confirmed order.

If we cannot supply a confirmed order, we will:

  • notify you;

  • cancel the affected order; and

  • refund any payment taken for that order.

We will not substitute a different fragrance without your agreement.

5. SMS and email communications

We may contact you by email or SMS about:

  • your Circle entry;

  • an incomplete entry;

  • selection outcomes;

  • membership;

  • forthcoming payments;

  • payment failures;

  • orders;

  • deliveries;

  • returns;

  • refunds;

  • account security;

  • product safety; and

  • important changes affecting the Circle.

General promotional marketing is handled separately and will only be sent where permitted by law.

Further information is provided in the Môr Privacy and Cookies Notice.

6. Orders and contract formation

When you submit an ordinary website order, you are offering to purchase the products in that order.

A contract for an order is formed when:

  • payment is successfully taken; and

  • we send you an order confirmation.

For Circle releases, a separate sales contract is formed for each seasonal release when payment is successfully taken and we send an order confirmation.

If we cannot accept an order, we will tell you and refund any payment taken.

7. Prices and payment

Prices will be displayed before an order is submitted or a Circle payment is taken.

Unless stated otherwise, displayed consumer prices include applicable UK taxes.

Any delivery charges will be shown before the order is completed.

Payments are processed through third-party payment providers such as Stripe.

Môr does not store complete payment-card details.

You confirm that you are authorised to use the payment method provided.

If a payment is reversed, disputed or fails after an order has been confirmed, we may suspend fulfilment while the matter is investigated.

8. Delivery

8.1 Delivery area

We currently deliver to addresses within the United Kingdom.

We may change our delivery area from time to time.

8.2 Delivery information

You are responsible for providing a complete and accurate delivery address.

Estimated delivery dates may be provided

  • at checkout;

  • in an order confirmation; or

  • in a dispatch notification.

Delivery estimates are not guarantees, but this does not affect your rights where goods are delivered late or are not delivered

8.3 Delays

If delivery is materially delayed, we will contact you where reasonably possible.

Your statutory rights relating to delayed or undelivered goods remain unaffected

8.4 Risk during delivery

The goods remain at our risk until they come into the physical possession of:

  • you; or

  • another person identified by you to receive them.

Where you specifically instruct a delivery provider to leave a parcel in a nominated safe place, delivery to that location may be treated as delivery to you.

8.5 Ownership

Ownership of the goods passes to you once:

  • payment has been received in full; and

  • the goods have been delivered.

9. Samples

A Circle order may include a sample vial so that you can try the fragrance before opening the full-size bottle.

Unless we tell you otherwise:

  • the sample vial is yours to keep;

  • you may use the sample vial before deciding whether to return the full-size bottle; and

  • the sample vial does not need to be returned.

Opening or using the supplied sample vial does not, by itself, reduce your refund for the unopened full-size bottle.

10. Cancellations, returns and refunds

10.1 Free-return facility in the member portal

The Môr member portal provides Circle members with an easy way to request a free return.

The portal return option is normally available for 14 days after payment is taken for the relevant seasonal release.

Where available, the portal allows you to:

  • notify us that you wish to return the order;

  • request a prepaid return label; and

  • obtain return instructions.

This portal facility is an additional convenience provided by Môr.

The expiry or unavailability of the portal option does not:

  • remove your statutory cancellation rights;

  • shorten the legal cancellation period;

  • remove your faulty-goods rights; or

  • prevent you from contacting us about a return.

10.2 Statutory right to cancel an online order

For most products purchased online, you may cancel the order without giving a reason.

You must tell us that you wish to cancel within 14 days beginning on the day after you receive the goods.

You can tell us by:

  • using the member portal, where available;

  • emailing jason@morperfumery.co;

  • using the model cancellation form at the end of these Terms; or

  • sending another clear statement explaining that you wish to cancel.

After notifying us, you must send the goods back within a further 14 days.

The statutory cancellation period is based on when you receive the goods, not on the date payment was taken.

10.3 Môr’s sample-first free-return promise

Môr provides a sample vial so that you can experience the fragrance without opening the full-size bottle.

For a full refund under our sample-first return promise, the full-size product should be returned:

  • unused;

  • unopened;

  • with any bottle seal intact;

  • with the bottle and label undamaged;

  • with the presentation box materially undamaged; and

  • with the remaining original contents and packaging.

You may open the outer delivery packaging and use the sample vial without affecting this promise.

For qualifying Circle returns under this promise, Môr will normally provide a prepaid standard return label.

10.4 Opening and inspecting the goods

You may handle and inspect the goods to the extent reasonably necessary to establish their nature, characteristics and condition.

Opening the outer postal packaging does not amount to improper handling.

However, opening or using the full-size perfume bottle will usually go beyond what is necessary where a separate sample vial has been provided for testing the fragrance.

10.5 Tampered, opened or damaged returns

If the full-size bottle, seal, label, presentation box or other product packaging has been:

  • opened;

  • broken;

  • altered;

  • tampered with;

  • materially damaged;

  • used; or

  • handled beyond what is reasonably necessary,

we may reduce the refund to reflect the resulting reduction in the product’s value, where permitted by law.

A deduction may be made where, for example:

  • the full-size bottle has been opened or sprayed;

  • the bottle seal has been broken;

  • fragrance is missing;

  • the bottle or label is damaged;

  • the presentation box has been torn, defaced or materially damaged;

  • parts of the product or packaging are missing; or

  • the condition of the returned product significantly reduces or removes its resale value.

Any deduction or charge will:

  • be proportionate;

  • reflect the actual reduction in value or reasonable loss caused by the condition of the return; and

  • only be applied where permitted by law.

We will not impose an arbitrary penalty or restocking charge.

Nothing in this section affects your rights where goods are faulty, unsafe, damaged on arrival, incorrectly supplied or not as described.

10.6 Returning the goods

Returned goods should be packaged carefully to avoid damage during transit.

Where we provide a prepaid return label, you should follow the accompanying instructions.

Any date displayed in the portal or on a return label does not shorten your statutory rights.

If the portal or label has expired while you still have a legal right to return the goods, contact us for return instructions.

Please retain proof of postage.

10.7 Refund amount

Where you validly cancel, we will refund:

  • the amount paid for the returned product; and

  • the cost of our least expensive standard outbound delivery option, where you paid an outbound delivery charge.

If you selected a more expensive or expedited delivery option, we do not have to refund the additional amount above the cost of standard delivery.

A refund may be reduced where the value of the goods has been diminished by handling beyond what was reasonably necessary, as explained in section 10.5.

10.8 Refund timing

We may withhold a refund until:

  • we receive the returned goods; or

  • you provide evidence that the goods have been sent back,

whichever occurs first.

We will process the refund without undue delay and within 14 days of the applicable date required by law.

Refunds will normally be made to the original payment method unless otherwise agreed.

10.9 Effect of a return on Circle membership

Returning a product does not automatically cancel Circle membership.

To stop future seasonal payments, you must separately cancel through:

  • the member portal; or

  • jason@morperfumery.co.

The online cancellation rules, including the 14-day period after delivery and possible proportionate deductions for handling that reduces value, are based on the Consumer Contracts Regulations.

11. Faulty, damaged or incorrectly supplied goods

We are responsible for supplying goods that are:

  • of satisfactory quality;

  • fit for purpose; and

  • as described.

Please contact jason@morperfumery.co as soon as reasonably possible if a product:

  • arrives damaged;

  • is faulty;

  • is unsafe;

  • is not as described;

  • is incomplete; or

  • is not the product you ordered.

Photographs may assist us in investigating delivery damage, but failure to provide a photograph does not automatically remove your statutory rights.

Where applicable, you may be entitled to

  • reject the goods and receive a refund;

  • receive a replacement;

  • receive a repair, where appropriate;

  • receive a price reduction; or

  • receive another remedy required by law.

The condition requirements in section 10 do not restrict your rights concerning faulty, damaged, unsafe or incorrectly supplied goods.

Consumers generally have a 30-day short-term right to reject faulty goods, with additional remedies potentially applying afterwards.

12. Product use and safety

Fragrance products should:

  • be used only as directed;

  • be kept away from children;

  • be kept away from flames, heat and ignition sources;

  • not be swallowed;

  • not be applied to broken or irritated skin; and

  • be stored appropriately.

Stop using a product if irritation or an adverse reaction occurs.

Ingredient and allergen information is provided on the product, packaging or accompanying documentation as required.

Nothing in this section limits our responsibility for a defective or unsafe product.

13. Gifts and additional items

A Circle box may occasionally include:

  • a complimentary gift;

  • artwork;

  • printed material;

  • a postcard;

  • a sample; or

  • another additional item.

Unless expressly stated otherwise:

  • complimentary items do not form part of the principal fragrance specification;

  • the nature of a gift may change;

  • gifts are subject to availability; and

  • an unavailable complimentary gift may be replaced with a reasonably comparable item or omitted.

This does not allow us to substitute the principal fragrance ordered.

14. Privacy

Our collection and use of personal information is explained in the separate Môr Privacy and Cookies Notice.

That notice explains:

  • what information we collect;

  • how we use it;

  • Circle SMS reminders;

  • selection-process information;

  • cookies;

  • service providers;

  • retention periods; and

  • your data-protection rights.

15. Intellectual property

Unless otherwise stated, original content owned by or licensed to Môr is protected by applicable intellectual-property laws.

Protected content may include:

  • the Môr name and logos;

  • product and fragrance names;

  • written website content;

  • original photography;

  • films;

  • graphics;

  • illustrations;

  • artwork;

  • label designs;

  • packaging artwork; and

  • other original creative materials.

Some artwork, photography and other materials may remain owned by contributing artists, photographers or other licensors.

You may view the website and retain reasonable copies for personal, non-commercial use.

You may not, without permission from the relevant rights holder:

  • reproduce protected material for commercial purposes;

  • publish or distribute protected material;

  • use Môr branding in a way that suggests an association or endorsement;

  • remove copyright or ownership notices; or

  • commercially exploit website or packaging content.

Nothing in these Terms claims exclusive ownership of general fragrance ideas, seasonal-release concepts, subscription methods or other ideas that are not capable of intellectual-property protection.

16. Website availability

We aim to keep the website and member portal available, but we do not guarantee uninterrupted access.

Access may occasionally be suspended because of:

  • maintenance;

  • technical failures;

  • security incidents;

  • provider outages; or

  • circumstances outside our reasonable control.

Where portal access is unavailable and you need to cancel membership or exercise a time-sensitive right, contact us by email.

17. External links

Our website may contain links to third-party websites.

We are not responsible for:

  • the availability of third-party websites;

  • their content;

  • their security; or

  • their privacy practices.

A link does not necessarily mean that Môr endorses the relevant third party.

18. Our responsibility to you

We are responsible for losses that are a foreseeable result of:

  • our breach of these Terms; or

  • our failure to use reasonable care and skill.

A loss is foreseeable where it was obvious that it would happen or where both parties knew it might happen when the contract was formed.

Our products are supplied for personal and domestic use.

Where you use a product for an unauthorised commercial or business purpose, we are not responsible for business losses such as:

  • loss of profit;

  • loss of revenue;

  • loss of business;

  • business interruption; or

  • loss of business opportunity.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • defective products where liability cannot lawfully be excluded;

  • breaches of statutory consumer rights; or

  • any other liability that cannot lawfully be excluded or limited.

19. Events outside our reasonable control

We are not responsible for a delay or failure caused by an event outside our reasonable control.

Such events may include:

  • severe weather;

  • natural disasters;

  • transport disruption;

  • strikes;

  • supplier failure;

  • utility or telecommunications failure;

  • cyber incidents;

  • government action;

  • changes in law;

  • public-health emergencies; or

  • shortages of essential materials.

Where such an event affects an order, we will:

  • contact you where reasonably possible;

  • take reasonable steps to minimise the effect; and

  • provide any cancellation or refund required by law.

20. Changes to the Circle or these Terms

We may update these Terms where reasonably necessary to reflect:

  • changes in law;

  • regulatory requirements;

  • changes to our products;

  • changes to payment or delivery arrangements;

  • security requirements;

  • changes to the member portal; or

  • reasonable changes to the operation of the Circle.

Changes will not retrospectively alter an order that has already been confirmed

Where a change materially affects continuing Circle membership, we will provide reasonable notice before it takes effect.

You may cancel membership through the portal before the change applies to a future payment.

21. Complaints

Please send complaints to:

Include, where applicable:

  • your name;

  • contact details;

  • order number;

  • relevant dates; and

  • a description of the issue.

We will investigate the complaint and aim to respond within a reasonable period.

22. Governing law and courts

These Terms are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you retain any mandatory consumer protections available under the law applicable where you live.

You may bring legal proceedings in the courts of the part of the United Kingdom in which you live.

Môr may bring proceedings only in courts permitted by applicable consumer law.

23. Other provisions

If a court finds that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply.

If either party delays enforcing a right, this does not necessarily mean that the right has been waived.

These Terms are between you and MOR PERFUMERY LIMITED.

No other person has a right to enforce these Terms except where the law provides otherwise.
